Jan Gruen is the managing partner of the firm's Walnut Creek office. She possesses more than 18 years of litigation experience representing home builders, landowners and businesses, in insurance and real estate matters.

Ms. Gruen represents and serves as a legal advisor to home builder clients and business clients on day-to-day risk management business and insurance matters, as well as more complex issues such as large scale construction defect claims by homeowner associations, contractual issues, subcontractor liability, loss recovery, warranty related matters and dispute resolution prior to the commencement of litigation. She is experienced in risk management and all forms of dispute resolution, including civil trials, arbitrations, mediation and pre-litigation settlement processes.

Ms. Gruen's experience includes the following representative matters:

  • Lead trial counsel for home builders in multi-million dollar construction defect cases
  • Insurance coverage disputes involving coverage available through primary policies of insurance and additional insured endorsements providing assistance to secure coverage through negotiation and litigation
  • Risk management counseling regarding litigation avoidance techniques and the use of alternative dispute resolution
  • Prosecution of breach of fiduciary duty claims
  • Representation of home builders in their capacity as board members of homeowners' associations in breach of fiduciary duty claims including the failure to set adequate reserves and budgets
  • Successful defeat of potential class action claims associated with construction defects
